These are the terms and conditions of our agreement which apply to all purchases of products by you from Woodland Herbs via this web site and you should read them carefully. By placing an order, you agree to and accept these terms and conditions. Terms may alter if necessary and therefore you should check them before you make a new purchase. Any variation of these Conditions shall be inapplicable unless agreed in writing by Woodland Herbs. To purchase from Woodland Herbs you must be resident in the United Kingdom. We cannot deliver any products outside of these areas. The products advertised in the Web Site are intended for sale to persons dealing as consumers and are not for re-sale.

Your use of this web site and any purchase by you on this web site of any products is governed by Scottish Law and will be deemed to have taken place in Scotland and subject to the exclusive jurisdiction of the Scottish courts.

Making a purchase could not be easier. Just browse our Catalog, and click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on "Order" and you will be asked for a few details that we need to be able to satisfy the order. We accept credit card payment including Visa and Mastercard. You may send your credit card information via phone, fax, mail or over the Internet.

Conditions of sale
No contract will exist between you and Woodland Herbs until Woodland Herbs accepts your order by email confirming that your order has been received. The advisory email sent by PROTX to confirm credit card details have been accepted is not an acceptance of the order. We are under no obligation to accept your order, but would normally do so where the product is available.

Description, Specification and Price
The description and specification of products in the Web Site is only approximate; We will endeavour to ensure that any variation in the specification of the products does not adversely affect the performance of products supplied. To the best of our knowledge the product descriptions on the site are accurate and up to date; but we are continually working to improve our products and so specifications or design changes may be made from time to time which have not been reflected on the site; We reserve the right to make changes which do not materially affect the quality or performance of those products. We include images of products on our site to help you with your selection, however all product images shown are for illustration purposes only. All measurements and weights are approximate.

Price and availability of products are subject to change and we reserve the right to withdraw any product from sale or to correct any error on the website without notice and without incurring any liability. The prices given in our product list, sales literature and web site are for information purposes only and do not represent an offer. No contract will come into existence until the customer's order (however given) is accepted. Invoices will be raised for prices current at the time of order. The price of the products will be the price quoted in the Web Site at the time we accept your order except in the case of manifest error. Prices are quoted inclusive of Value Added Tax at the applicable rate.

We will notify you of our acceptance of your order by email shortly after we receive it and at that point a binding agreement between us will be in place based on these terms and conditions. If we do not accept your order for any reason or the price of the product has increased between the time of the order and our acceptance of it (or if a supplementary delivery charge applies), we will email you to advise you of the change. You will then need to confirm your amended order.

Payment of the price of an order must be received by Woodland Herbs and cleared before delivery. Payment can be made by any major credit or debit card, and will be debited and cleared from your account before the despatch of your Goods. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Product Suitability
Woodland Herbs' products are used for a wide variety of purposes; It is the absolute responsibility of the customer and consumer to ensure that the products are appropriately used. Regulations issued by the Medicine Advertising Regulations Act; the Medicines Act 1965 and the Medicines Control Agency severely inhibits the description and application of many of our products. If you need help, don't hesitate to contact us.

Ownership of Goods
Goods remain the property of Woodland Herbs Limited until paid for in full.

Delivery is available within the UK and NI. In addition to the price of the goods, you will have to pay our delivery charges as quoted in the Web Site at the time we accept your order. Postage and Packaging charges are calculated by weight. We normally use Royal Mail for out deliveries*.

FREE delivery is available on orders over £100.

* Although 1st Class Delivery usually takes between 1 – 3 working days from the despatch date, it's been our experience that the majority of late packages arrive just a day or two after this estimated delivery period. Please be aware however that although NOT the norm, delays on this service can result in orders taking up to 15 days to arrive.

Order online or by telephone and we make every effort to despatch within 24 hours of order placement. Parcels should then reach you within 3 working days, but please allow up to 14 days.

Please note that deliveries are made to the address you supply to us. You can also arrange for your order to be delivered to alternative addresses including your office, members of your family or your local post office.

In the case of orders for items not in stock, large quantities, special requests or due to unavoidable delays we endeavour to ensure despatch within 5 days. You will always be emailed with the option to cancel your order if you would rather not wait.

We may, at our discretion and expense, deliver parts of your order separately. Risk of damage or loss of the goods shall pass to the Buyer on delivery. Any dates quoted for delivery are approximate only. We will accept no responsibility for any loss resulting from delivery delays.

Every effort is made to ensure all products listed in our promotional material are in stock, but please note that some herbs are subject to seasonal shortages. We do not accept any responsibility for loss resulting from any out of stock items.

For all orders 20% VAT is added where appropriate.

All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.

Woodland Herbs warrants that Services and Goods will at the time of Delivery correspond to the description given by Woodland Herbs. The products which are sold via this web site have been designed to comply with the statutory legal requirements and relevant safety standards of the United Kingdom. We can therefore make no representation or warranty that any product is compliant with health, safety or other legal requirements which apply outside the United Kingdom.

Exclusions
To the extent that we are lawfully able to do so, we expressly disclaim all warranties of any kind; including but not limited to; warranties of title; fitness for a particular purpose; merchantability and non-infringement of proprietary or third party rights. We make no warranty that the web site and our services or any information will meet your requirements, that your access to and use of the services will be error free and that any errors or inaccuracies will be corrected. Further if your use of the web site results in the need for servicing or replacing equipment or data this will not be at our risk and expense.

We expressly disclaim any claims, losses and/ or damages of any nature resulting from: (a) unauthorised access to or alterations of your transmissions or data; (b) statements or conduct of any third parties. (c) defect in the goods arising from incorrect storage by the customer. Dried herbs should be kept in air-tight opaque containers in a cool place out of direct sunlight. If cared for correctly, herbs will remain active for long periods.

You agree that; your use of the web site and our services is at your sole risk; The web site and services are provided on an as is and as available basis. No advice or information, whether oral or written, obtained by you through or from the web site or from our services will create any warranty not expressly stated in these terms and conditions. You agree to indemnify Woodland Herbs and its Directors and hold us harmless from and against any claims; actions or demands, including any legal fees incur in connection therewith, resulting from your misuse of our web site or your breach of these terms and conditions. We will notify you promptly of any such claim, action or demand and will assist you as may be reasonably necessary providing you meet our costs and expenses, including our legal fees. In no event will our liability arising out of or in respect of these terms and conditions exceed £UK 1,000 and that in no event will we be liable for any loss of profits, goodwill, loss of business, loss of data or any other indirect or consequential loss or damage whatsoever, except that this exclusion of liability does not apply to any damages in connection with death or personal injury caused by the negligence of Woodland Herbs Limited, its directors or employees.

Other Exclusions
We will not be liable to you for any breach of our agreement, for delay or failure to perform if the delay or failure is due to acts of God, civil commotion, riots, floods, drought, fire, legislation or other cause beyond our reasonable control. This does not affect your statutory rights. If we choose not to enforce a right under our agreement, that decision will not prevent us from enforcing other rights, or the same right on a later occasion.

As we are not responsible for the operation of the secure link we will not, unless we are negligent, be liable for any loss you may suffer if a third party obtains unauthorised access to any information you provide via such link.

The Contracts (Rights of Third Parties) Act 1999 shall not apply to any contract between us, so that no contractual rights are conferred on third parties.

If any of these terms and conditions are found to be invalid then that provision shall not affect the validity of the remaining provisions which shall remain fully enforceable.

Provided you keep your receipt; and the goods are unopened and it is within 7 days of the date; you may exchange these goods or get a credit;debit card;cheque refund; depending on the method of your payment. You may cancel your order by notifying us in writing at any time up to 7 days after your products have been delivered. The notification should state your order number and give the reason for cancellation. If you cancel your order after we have despatched the products; then you must return the products with the original documentation sent with each parcel to us. The products should be returned in a reasonable condition and delivery costs of returning any product will be payable by you. We recommend the use of a Recorded Delivery Service. We will credit your credit card promptly or issue a refund.

You can no longer cancel your order once you have opened the product containers or used the products; However; your statutory rights concerning the quality of those products will be unaffected

Returning Incorrect or Damaged Goods
In the unlikely event that your order is incorrectly shipped or found to be damaged or defective, we shall give a full refund or replacement. Please contact us within 10 days of receipt of your goods. Returns should then be sent back to us at Woodland Herbs, 100 Woodlands Road, Glasgow, G3 6HB, including a copy of the original invoice. We will reimburse the cost of postage and packaging. The statutory rights of the customer are not affected by these conditions.

The "Consumer Protection (Distance Selling) Regulations 2000" apply.

If you wish to return your product to us for any other reason not covered by sections above please contact us. In the event that you dislike or experience a reaction to one of our products, contact us.

We accept credit cards including Visa and Mastercard, Switch, Maestro and Delta cards. Alternatively you may use a cheque by printing our your order form and posting it to us with a cheque. Gift vouchers are not accepted for online purchases.
